Terms of Service

Proceeding with any transaction means that you agree to the terms and conditions outlined below:

🟡 orribu (”the Artist”) reserves the right to refuse service to or blacklist any client, especially ****if the requested content violates copyright laws, makes her uncomfortable, or is morally/ethically compromising (content which includes but is not limited to: violence/gore, hate speech, sexual/drug abuse, etc.).

🟡 Unless exclusivity terms are negotiated, documented and signed by both parties, the Artist reserves the right to display the commissioned work in her portfolio and/or blog, including progress snapshots.

🟡 Unless the Artist and client negotiate a full terms of release and/or a license fee, the Artist’s work CANNOT be used commercially, nor can her signature be removed.

🟡 Unless otherwise negotiated and agreed upon in writing by both parties, the Artist’s work CANNOT be altered in any way.

🟡 Payment is due before the artist starts work. Payment plans can be negotiated and must be agreed upon in writing and signed by both parties.

🟡 An estimated turnaround will be provided when the Artist initially reaches out to you via email or direct messaging. Please respect the Artist’s time and energy. Repeatedly messaging the Artist (multiple times a day/week) both during and outside of the estimated turnaround period and Office Hours will be considered harassment and grounds for terminating the project without a refund. The Artist will retain full rights to the work performed. Rush commissions are not available at this time.

🟡 As this is a service, it is not fully refundable once the Artist starts work. In the event that you need to cancel the commission after the Artist has begun work (indicated by the Artist sending an estimated turnaround), please notify the Artist via email at commissions@orribu.co. We will negotiate the terms for the cancellation and you’ll get a partial refund. Note that repeated cancellations may result in blacklisting at the Artist’s discretion.

🟡 All digital products and services are purchased with the understanding that tangible items will not be made nor shipped unless otherwise agreed upon in writing with the artist.

🔴 If the Client has given the Artist permission to work on the commission live and it is a skeb-like, this does not grant them the ability to request revisions. Unsolicited feedback given (i.e. “their head should be smaller”, “i wish you’d made their hair a different color”, etc.) will be ignored. Repeated unsolicited feedback will result in a timeout/ban from chat at the Artist’s discretion, and the project may be terminated. No refund will be provided.

🔴 If the Artist has started work, DO NOT INITIATE A CHARGEBACK. Chargebacks are immediate grounds for blacklisting and the Artist has the right to pursue legal action.

🔴 For skeb-like or “surprise-me” commissions, neither WIPs nor revisions are available. If you wish to have more involvement with the process (allowing for WIPs and a negotiated number of revisions), please fill out the commission form here.

🔴 These commissions are to be SFW/SFM (safe for work/minors) only. NSFW commissions are not available at this time and cannot be provided on this platform.

🔴 Images purchased through commissions may not be used outside the written and/or agreed-upon terms, i.e. these Terms of Service. They also cannot be revised or modified in any way, including but not limited to: the Artist’s signature being removed, cropped, color adjustments, etc.

🔴 UNDER NO CIRCUMSTANCES can images purchased through this service be used for blockchain purposes NOR genAI training, even with a commercial license.

🔴  Blockchain/genAI Policy: The Artist absolutely does not create or participate in any blockchain-related technology. If the resulting product or any part of the process is used as such, the artist will respond with appropriate legal action and demand monetary compensation. This would constitute as unauthorized commercial use as well as a violation of the Artist’s Blockchain Policy.

These conditions can and will be updated without notice but will be dated for transparency.
